سیکشن 375: ریپ کیا ہے؟ / Section 375: What is Rape?
ریپ کی تعریف PPC سیکشن 375 میں دی گئی ہے۔ 2020-2021 کی ترمیم کے بعد یہ تعریف gender-neutral (مرد، عورت یا ٹرانس جینڈر) ہو گئی ہے۔
English Definition (Current Law): A person A commits rape if A:
- Penetrates his penis into the vagina, mouth, urethra or anus of B (or makes B do so); or
- Inserts any object or body part (not penis) into those areas; or
- Manipulates B’s body to cause penetration; or
- Applies mouth to those areas.
This happens: against B’s will, without consent, with consent obtained by fear of death/hurt, fraud (believing A is husband), intoxication, if B is under 16, or if B cannot communicate consent. Explanations: Consent must be clear and voluntary. No resistance alone does not mean consent. Vagina includes labia majora. Bona fide medical procedure is NOT rape. Rape includes gang rape. “Person” = male, female or transgender.
اردو ترجمہ: شخص A ریپ کرتا ہے اگر وہ B کے جسم ( vagina, mouth, urethra یا anus) میں penis، کوئی چیز یا جسم کا حصہ ڈالے یا B سے ایسا کروائے، یا منہ لگائے۔ یہ B کی مرضی کے خلاف، بغیر رضامندی، ڈر، دھوکے، نشے، 16 سال سے کم عمر یا B بات نہ کر سکے تو ہوتا ہے۔ رضامندی واضح ہونی چاہیے۔ طبی علاج ریپ نہیں۔ gang rape بھی شامل۔
یہ تعریف 2006 اور 2016 کی ترامیم کے بعد مزید واضح ہوئی، لیکن 2020 آرڈیننس نے اسے جدید بنایا۔ (The 2020 Ordinance modernised this definition.)
سیکشن 376: ریپ کی سزا / Section 376: Punishment for Rape
English: Whoever commits rape shall be punished with death or imprisonment for a term not less than 10 years but which may extend to 25 years or imprisonment for the remainder of natural life + fine.
- Rape of minor or person with disability: death or life imprisonment + fine.
- Public servant (police, doctor, jailor) using position: death or life + fine.
- Gang rape (Section 375A): death, remainder of natural life or life imprisonment + fine for each person.
- Repeat offender or exceptional case: Chemical castration possible (court order).
- Disclosing victim’s identity (376A): Up to 3 years + fine.
اردو: ریپ کی سزا: موت یا 10 سے 25 سال قید یا زندگی بھر قید + جرمانہ۔ بچے یا معذور پر: موت یا عمر قید۔ پولیس/ڈاکٹر وغیرہ نے: موت یا عمر قید۔ gang rape: ہر شخص کو موت یا زندگی بھر قید + جرمانہ۔ دوہرے مجرم: chemical castration بھی ہو سکتا ہے۔ نام ظاہر کرنے پر: 3 سال قید + جرمانہ۔
2020 اینٹی ریپ آرڈیننس اور ترامیم / 2020 Anti-Rape Ordinance and Amendments
2020 میں Motorway gang rape کیس کے بعد صدر نے Anti-Rape (Investigation and Trial) Ordinance اور Criminal Law (Amendment) Ordinance جاری کیا۔ یہ 2021 میں Act بن گیا۔ اہم تبدیلیاں (Key Changes):
- تعریف gender-neutral اور وسیع۔
- سزائیں سخت (remainder of natural life)۔
- Special Joint Investigation Teams (JIT) اور Special Courts۔
- DNA testing لازمی۔
- Two-finger test banned (متاثرہ کی عزت کے لیے)۔
- In-camera trial (بند کمرے میں مقدمہ)۔
- Victim identity protected۔
- Chemical castration option۔
- Anti-Rape Crisis Cells (ARCCs) قائم (اب Islamabad, Karachi, Lahore, Multan, Rawalpindi میں فعال، 24 گھنٹے)۔
یہ ترامیم مقدمات کو 4 ماہ میں ختم کرنے اور متاثرین کو فوری مدد دینے کے لیے ہیں۔ (These changes ensure faster trials and better victim support.)
سیکشن 377: غیر فطری جرائم / Section 377: Unnatural Offences
English Definition & Punishment: Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal shall be punished with imprisonment for life, or imprisonment of either description for a term not less than 2 years nor more than 10 years, and shall also be liable to fine. Explanation: Penetration is sufficient. (Note: Later additions like 377A/377B cover sexual abuse of children with harsher penalties, e.g., life or death in extreme cases with minors under 7-18.)
اردو: کوئی بھی شخص مرد، عورت یا جانور کے ساتھ فطرت کے خلاف جنسی عمل (carnal intercourse) کرے تو عمر قید یا 2 سے 10 سال قید + جرمانہ۔ وضاحت: Penetration کافی ہے۔ بچوں کے ساتھ اضافی سخت سزائیں (377C وغیرہ) بھی ہیں۔
یہ سیکشن 1860 سے ہے اور homosexuality سمیت غیر فطری اعمال پرلاگو ہوتا ہے۔
رپورٹنگ کا طریقہ کار / Reporting Procedures
- FIR درج کروائیں: قریبی پولیس سٹیشن یا Anti-Rape Crisis Cell جائیں۔ ریپ cognizable offence ہے – پولیس انکار نہیں کر سکتی۔
- طبی معائنہ: فوری Crisis Cell یا medicolegal officer سے (24-48 گھنٹے بہتر، لیکن دیر سے بھی ممکن)۔ DNA، medical evidence جمع۔
- JIT: سنگین کیسز میں Joint Investigation Team بنتی ہے۔
- Special Court: مقدمہ Special Court میں، in-camera، video link سے۔
- وقت: FIR فوری، تفتیش 2 ماہ میں، ٹرائل 4 ماہ میں۔
اردو: پولیس سٹیشن یا Crisis Cell جائیں، FIR درج کروائیں۔ فوری طبی معائنہ کروائیں۔ DNA ٹیسٹ ہو گا۔ مقدمہ خصوصی عدالت میں بند کمرے میں چلے گا۔
متاثرہ افراد کے حقوق / Victim Rights
- تحفظ: Identity چھپائی جائے گی۔ Witness protection program (relocation, financial help, safe houses)۔
- مفت مدد: Legal aid (Legal Aid Authority)، Independent Support Adviser (psychologist/lawyer)۔
- Crisis Cells: 24/7 medical, counselling, forensic, legal help in one place (Karachi سے شروع، اب 6 شہروں میں)۔
- کوئی blame نہیں: Two-finger test نہیں، victim-blaming illegal۔
- Compensation: Court سے جرمانہ متاثرہ کو مل سکتا ہے۔
- Privacy: In-camera trial، video testimony۔

نتیجہ / Conclusion
