Learn how Lahore High Court explained the law about shouting Lalkara during a crime and why the bail of the accused was dismissed under Section 497 Cr.P.C. (2021 PCrLJ 47 Lahore). Detailed Urdu + English explanation for law students and advocates.

📜 Case Law Reference:

Citation: 2021 PCrLJ 47 (Lahore)
Bench: Lahore High Court
Subject: Post-Arrest Bail – Lalkara – Section 497 Cr.P.C

“A person burdened with the allegation of shouting lalkara is generally granted post-arrest bail, but this rule is not inflexible.”

If the record shows that the accused had deep-rooted interest in the crime and was in a commanding position, his act of shouting lalkara becomes a significant overt act in the commission of the offence.

🧠 Legal Analysis | Section 497(1) Cr.P.C.

According to Section 497(1) Cr.P.C., post-arrest bail depends on whether reasonable grounds exist to believe that the accused is guilty.

In this case, the Court found that:

  • The accused did not attempt to stop the violence.

  • Instead, he provoked others by shouting Lalkara.

  • His act led to the death of two real brothers.

Result: Bail Dismissed

The Lahore High Court dismissed the bail of the accused, stating that his Lalkara was not a mere shout but a commanding act contributing to murder.

Held:

“Since the petitioner was in a position of influence but failed to pacify the situation, rather ignited it through his lalkara resulting in two murders — Bail Dismissed.”

📚 Key Takeaways for Law Students & Lawyers

  • Lalkara (للکارا) can be considered an active participation in crime if done with intent and influence.

  • Bail under Section 497 Cr.P.C. is not automatic even for verbal acts if they contribute to the offence.

  • Judicial discretion depends on the accused’s role, intent, and control over co-offenders.
