سپریم کورٹ میں پولیس افسران کے سیاسی بنیادوں پر تبادلوں سے متعلق کیس کی سماعت ہوئی۔عدالت عظمی میں معاملہ کی سماعت چیف جسٹس عمر عطا بندیال کی سربراہی میں تین رکنی بنچ نے کی۔عدالت نے پنجاب اور خیبرپختونخوا حکومت کو پولیس آرڈر 2002 پر عملدرآمد کرنے کا حکم دیتے ہوئے افسران کے تبادلوں سے روک دیا۔
عدالت عظمی نے اپنے حکم میں پولیس افسران کے قانون میں درج وقت سے پہلے تبادلوں پر پابندی عائد کرتے ہوئے قرار دیا ہے کہ مقررہ وقت سے پہلے تبادلہ ناگزیر ہو تو وجوہات تحریر کی جائیں، کسی بھی افسر کو سینئر پولیس افسر کی مشاورت کے بغیر نہ ہٹایا جائے.عدالت نے سندھ اور بلوچستان میں بھی گڈ گورننس کیلئے یہی فارمولا اپنانے کی تجویز دیتے ہوئے عدالت نے صوبائی حکومتوں سے گزشتہ دس سال میں تبدیل کئے گئے افسران کی فہرستیں بھی طلب کرلی ہیں۔
دوران سماعت چیف جسٹس عمر عطا بندیال نے ریمارکس دیئے کہ پنجاب حکومت خود قانون پر عمل کرے گی یا عدالت حکم دے؟ پنجاب حکومت خود قانون پر عمل کرے تو عدالتی حکم کی ضرورت نہیں پڑے گی، جرائم اور عدم تحفظ کی وجہ سے عوام متاثر ہو رہی ہے۔
The basic principles of law etched in provisions of the Police Order , 2002 with respect to postings and transfers of police officers are : firstly , that a minimum statutory tenure in the post should be observed ; secondly , if a premature transfer has to be made , the same should be done with the consultation of the concerned superior officer in the police establishment ; and thirdly , the reasons for such transfer should be duly recorded . These principles expressed by the Statute are derived from the jurisprudence on good governance laid down by this Court in furtherance of the requirements under the Constitution . We expect that all the Provincial Governments shall abide by these principles . faithfully . In any event , for the provinces in which the Police Order , 2002 is in force , we invite the comments of such governments on why the provisions thereof are not being implemented . On a parity of reasoning in the other provinces and taking guidance from the wisdom of the Constitution , we issue notice as to why its principles of good governance should not be implemented on postings and transfers made in their police departments .
