Respectfully Sheweth:-
1. That the respondents No:-*00* & 4 are Co~accused (hamrahi-Mulzim, Suspect) of the petitioner and are Performa respondents in the above said writ petition.
2. That the petitioner has been involved in the above said case on the false allegation that the petitioner alongwith respondents No:-*00* & 00 ploughed the Khal of the complainant and threatened the complainant and his other relatives. The copy of the same is appended herewith as ANNEX-A.
3. That the petitioner and other Co~accused (hamrahi-Mulzim, Suspect) applied for the grant of Pre~arrest Bail in the Court of Mr. [Name...] Learned ADSJ, [Name...] in which the Learned ADSJ [Name...] was pleased to grant Ad~interim Pre~arrest Bail till [dd-mm-yyyy] to the petitioner and other Co~accused (hamrahi-Mulzim, Suspect) and the next date of hearing is fixed for [dd-mm-yyyy]. Copy of the Robkar is attached herewith as ANNEX-B.
4. That now the petitioner seeks kind indulgence of this Honourable Court for quashing of the above said FIR inter alia on the following:-
GROUNDS
جھوٹ اور بدنیتی پر مبنی مقدمہ
a. That the above said case is wholly false and mere outcome of malafide of the complainant with the active connivance of local police.

b. That there is Un~explained delay of about six months in lodging the FIR which makes the story of the prosecution is doubtful.

c. That in-fact the petitioner’s party are real owner of the land measuring *00*-Kanals situated at Mauza [Name...] District (Zila) [Name...] and the complainant/respondent No:-00- is also owner of the land measuring 00-Kanal and the said land belongs to inside the petitioner’s land and the water-machine of the complainant/respondent No:-00- was out of order and due to intervention of the respectables of the locality the petitioner asked the complainant/respondent No:-00- to use his water-machine and the complainant on the land measuring *00*-Kanal when the petitioner asked the respondent No:-00-/ complainant to repair his water-machine and on this the complainant started threatening the petitioner and due to this reason the complainant/respondent No:-00- lodged the instant FIR.

d. That according to Fard-e-Malkiat the petitioner and others are joint owners of Khata, Khewat No:-*00* Khatooni No:-*00* *00* *00*/*00* *00*/00-, Khasra Nos. *00* *00* *00* *00* *00* land measuring *00*-Kanal. Copy of Fard-e-Malkiat is attached herewith as ANNEX-C.

e. That when the complainant/respondent No:-00- submitted an application to the respondent No:-*00* for registration of case against the petitioner and other Co~accused (hamrahi-Mulzim, Suspect) in which the respondent No:-*00* forwarded the same to DSP, Legal [Name...] for further comments in which the SP prepared his report that from the contents of the application no offence is made out against the petitioner/accused (Mulzim, Suspect). Copies of Legal Comments and report of SP are attached herewith as ANNEXED (ATTACHED)-D&E.

f. That on the continues threat of the complainant/respondent No:-00- petitioner filed an application u/s 22-A & 22-B CrPC before Learned Justice of Peace [Name...] for not harassing the petitioner and his other family members on [dd-mm-yyyy] and due to this the respondent No:-*00* just to save his skin lodged the instant FIR. Copy of petition, police comments and order are attached herewith as ANNEXED (ATTACHED)-F,G&H respectively.

g. That it is also pertinent to mention here that the petitioner also filed a civil suit against the complainant/respondent No:-00- before the Learned Civil Judge, [Name...] in which the Learned Civil Judge was pleased to grant status-quo in favour of the petitioner. Copy of civil suit and order are attached herewith as ANNEXED (ATTACHED)-I&J respectively.

h. That bare reading of the FIR, alleged offences has not made out.

i. That the offences mentioned in the First Information Report do not fall under the prohibitory clause.

j. That the very registration of the above said case and its continuation is only abuse of process of law and the FIR is based on false story. Therefore liable to be quashed.

k. That the very registration of the above said FIR is illegal, unlawful and without lawful authority which has been got registered by the complainant.

l. That there is no other efficacious alternative and speedy remedy except to invoke the constitutional jurisdiction of this Honourable Court.
PRAYER
In the light of above stated facts, it is humbly prayed that this writ petition may graciously be accepted and impugned FIR No:-No.*00*/*00* Dated [dd-mm-yyyy] Offence u/s 0/0-0, 148/149 PPC registered at PS [Name...] District (Zila) [Name...] may kindly be declared as illegal, unlawful and the same may kindly be quashed in the interest of justice and equity.
It is therefore most respectfully prayed that till the final disposal of the writ petition the respondent No:-*00* may kindly be directed not to cause any illegal harassment to the petitioner and his family members.
It is further prayed till the final disposal of the main writ petition the operation of the impugned FIR may kindly be suspended in the interest of justice.
