Difference Between Substantive Law and Procedural Law

 

There are two kinds of Law


1. Substantive Law 2. Procedural Law

(Pakistan Penal Code)

(Crpc, Cpc)

1) Substantive Law:

Substantive Law is that law which not Only provide Cause of action but also remedy of that "Cause Of Action". Substantive law deals with rights and duties and Procedural law deals with remedies and process by which these remedies are made available.

Substantive Law Examples

(Cause of action) (Remedy)
( Murder of A) ( Death Penalty/ Life. Imprisonment to B)

Example :

A caused murder of B, C is Brother of B, C has Grievance against A.
A is punishable under Section 302 PPc.
Now the question is how accused person would be punish under Law, There is code of Criminal Procedure Code through which accused person has to go in order to meet the end of Justice.

2) Procedural Law:

Procedural law is that law, which gives us the process which every trial Court is bound to observe in order to convict or acquit an accused person.
