Procedure of Investigation in Blasphemy PPC 295 Cتوہینِ رسالت ﷺ کے مقدمات میں تفتیش کا طریقہ کار




The procedure of investigation in blasphemy cases under Section 295-C of the Pakistan Penal Code (PPC) is as follows:

  1. A complaint is filed with the police by the victim or a person on their behalf.
  2. The complaint is then forwarded to the Superintendent of Police (SP), who is the only police officer authorized to investigate blasphemy cases.
  3. The SP will appoint an investigating officer (IO) to conduct the investigation.
  4. The IO will record the statement of the complainant, the accused, and any witnesses.
  5. The IO will also collect any evidence, such as documents, photographs, or videos, that may be relevant to the case.
  6. After the investigation is complete, the IO will submit a report to the SP.
  7. The SP will then decide whether to file a charge sheet against the accused in court.

The following are some of the special procedural safeguards that apply to blasphemy cases:

  • No police officer below the rank of SP can investigate a blasphemy case.
  • The accused cannot be arrested without a warrant.
  • The accused has the right to legal representation.
  • The accused has the right to bail.
  • The trial must be held in camera (in private).
