Procedure of Investigation in Blasphemy PPC 295 Cتوہینِ رسالت ﷺ کے مقدمات میں تفتیش کا طریقہ کار
The procedure of investigation in blasphemy cases under Section 295-C of the Pakistan Penal Code (PPC) is as follows:
- A complaint is filed with the police by the victim or a person on their behalf.
- The complaint is then forwarded to the Superintendent of Police (SP), who is the only police officer authorized to investigate blasphemy cases.
- The SP will appoint an investigating officer (IO) to conduct the investigation.
- The IO will record the statement of the complainant, the accused, and any witnesses.
- The IO will also collect any evidence, such as documents, photographs, or videos, that may be relevant to the case.
- After the investigation is complete, the IO will submit a report to the SP.
- The SP will then decide whether to file a charge sheet against the accused in court.
The following are some of the special procedural safeguards that apply to blasphemy cases:
- No police officer below the rank of SP can investigate a blasphemy case.
- The accused cannot be arrested without a warrant.
- The accused has the right to legal representation.
- The accused has the right to bail.
- The trial must be held in camera (in private).
